Procedure For Building A Shed, Gazebo Or Play Structure

120 Square Feet Or Smaller In Size With A Height Of Ten Feet Or Less:

  1. Requires a development permit
  2. 2. May be placed as close as three feet from the side and rear property lines -- as measured to the eaves if the shed has eaves--provided it does not encroach on an active utility easement
Over 120 Square Feet Up To 200 Square Feet In Size With A Height Of Ten Feet Or Less:
  1. Requires a development permit
  2. Must conform to setback requirements, except that it may be placed as close as three feet from the rear property line provided it does not encroach on an active utility easement
Over 200 Square Feet In Size With A Height Of Ten Feet Or Less:
  1. Requires a building permit
  2. The fee is based on the valuation of the structure
  3. Must conform to setback requirements, except that it may be placed as close as three feet from the rear property line provided it does not encroach on an active utility easement
  4. Must go through construction plan review process
Over 10 Feet In Height:
  1. Requires a building permit
  2. The fee is based on the valuation of the structure
  3. Must conform to setback requirements of the underlying zoning
  4. Must go through construction plan review process

  2. The maximum floor area of any one accessory structure is 1,000 square feet
  3. The maximum height allowed under the Development Code is 20 feet or the height of the dwelling, whichever is less. Height, for purposes of complying with the Development Code standards, is defined as: “The vertical distance from the average grade to the highest point of the roof of the building.” The measurement of the height of the structure must include the height of foundation blocks or slab foundation used under the accessory building. The applicant shall include an elevation drawing or picture of the structure with the height dimension based upon this definition
  4. Submit a plot plan with the Development Permit or Building Permit application that shows all property lines, the location of the structure and the floor area (width and depth), setbacks to the property lines to the eaves of the structure, and show the location and floor area of all other existing detached accessory structures on the property
      • a) The cumulative area of detached accessory structures shall not exceed 25% of the gross lot area
      • b) The cumulative area of detached accessory structures shall not exceed 50% of the required rear yard area
  5. The setback on a street side (corner lot) for an accessory structure not used for storage of vehicles is 10 feet regardless of square footage. Accessory structures used for storage of vehicles on the street side of a corner lot must be setback 20 feet from the street side property line
  6. Accessory structures on lots within the 100-year floodplain require a Flood Hazard Permit rather than a Development Permit as well as a Building Permit, if required
  7. A play structure, regardless of area or height, requires only a Development Permit
